Below we present our General Terms and Conditions (hereinafter referred to as "GTC"). These T&Cs apply to the Westwing online shop on the www.westwing.fr website. By placing your order, you agree to the following general terms and conditions of Westwing GmbH (limited liability company), registered under Westwing GmbH, Moosacher Str. 88, 80809 Munich, Germany, service@westwing.fr, VAT No. DE815289147 (hereinafter referred to as "Westwing").
These T&Cs apply to consumers with a billing address in France who make use of the offers of goods (i.e. all types of products) described on our website. A consumer, within the meaning of these T&Cs, is any natural person who acts for purposes that do not fall within the scope of his or her commercial, industrial, artisanal, liberal or agricultural activity.
1. GENERAL AND SCOPE OF APPLICATION
1.1 Westwing operates an online store on the www.westwing.fr website.
1.2 To enter into a contract with regard to the available offers, you must be at least 18 years old.
1.3 In principle, goods are only sold in quantities that are considered customary for a household.
1.4 These T&Cs apply to all contracts concluded via the www.westwing.fr website, unless separate B2B T&Cs apply to professionals acting for purposes within the scope of their commercial, industrial, artisanal, liberal or agricultural activity.
1.5 Where (working) days are indicated as a deadline, these are all days of the week, with the exception of Saturdays, Sundays and public holidays.
2. USE OF THE WWW.WESTWING.FR SITE AND REGISTRATION
2.1 When you order goods, you are asked to provide personal data which is collected and processed in accordance with Westwing's Privacy Policy. Article 19 (protection of personal data) applies to such processing.
2.2 You are responsible for the completeness and veracity of the data provided. You are also required to keep your data up to date. In the event of any changes to the data provided when using the website, you must correct the information immediately to keep it up to date. You are responsible for maintaining the confidentiality of your passwords and other access data and for protecting them from access by unauthorised third parties.
2.3 If you create a customer account, you will receive confirmation of your registration by e-mail after completing the registration process (so-called " double opt-in ").
2.4 You are solely responsible for the content (such as property reviews) that you post in the areas accessible for this purpose. You warrant that your own content does not infringe the rights of third parties (e.g. personality rights or copyrights). In this regard, you agree to indemnify Westwing in full in the event of a claim by a third party for infringement of its rights. By providing content to Westwing, to enable Westwing to lawfully publish such content, you grant Westwing and all affiliates of the Westwing group (the " Westwing Group ") that may publish the content of the site the right to reproduce and represent such content for the term of the copyright and throughout the world, This is without prejudice to the future enjoyment of your own rights in such content.
2.5 In your customer account, you can view and, if necessary, change your current, recently sent and/or completed orders, as well as manage and store your own data, vouchers, newsletters and notifications.
2.6 You may only register with one customer account on the www.westwing.fr Site and use only one customer account at a time. If Westwing detects several recordings, it reserves the right to proceed with a possible deletion.
2.7 It is forbidden to use the www.westwing.fr website or its content for purposes that are illegal, abusive or prohibited by law and these GTC. In particular, technical processes must not be disturbed or manipulated. In the event of unjustified behaviour or attempts to obtain unjustified advantages to the detriment of Westwing or other customers, Westwing reserves the right to block the customer's account and not accept orders, without prejudice to the observance of acquired rights and rights of defence.
2.8 Without prejudice to the rights of consumers recognised by law, including the right of withdrawal detailed below in Article 12, Westwing reserves the right to safeguard its rights at its own discretion and, for example, to issue warnings, refuse orders, limit the available means of payment, suspend or interrupt access to the www.westwing.fr Website or take any appropriate measures in the event of a breach of the provisions of the these T&Cs or abuse of rights, as well as to claim any damages and interest compensating for its prejudices.
3. CONTRACTING PARTIES, LANGUAGE AND CONCLUSION OF THE CONTRACT
3.1 The contracting party to the conclusion of contracts on the www.westwing.fr website is Westwing.
3.2 The www.westwing.fr website is operated in French. Contracts concluded through the website are concluded exclusively in French.
3.3 The offer of goods on the www.westwing.fr website is not a binding offer. The offer is to be understood as a non-binding invitation to submit a purchase offer (" invitatio ad offerendum "). Once the selected goods have been placed in the virtual shopping cart and the electronic ordering process has been completed, you make a legally binding contractual offer by placing an order for the goods in the virtual shopping cart by clicking on the "pay now" or "complete payment" button. After placing your order, you will receive an email from Westwing notifying you that your order has been received. This email from Westwing does not constitute acceptance of the contract. Westwing is free not to accept an order. If an order cannot be fulfilled by Westwing, Westwing will notify you without delay. Acceptance of the contract by Westwing is made by a separate e-mail confirming the acceptance of the order and the dispatch or delivery of the goods (at the latest when the goods are dispatched).
3.4 Westwing stores the order data and sends it to you by e-mail after receipt of an order. This email also contains the conditions for withdrawal. You can also download the general terms and conditions at any time at www.westwing.fr/i/terms_and_conditions. If you created a customer account before placing your order, you can still view the order details in that account. This also applies to previously placed orders, within the limits of the retention of information related to these orders.
3.5 Order processing and contact is usually done by automated order processing or by e-mail. You must ensure that the email address you provide for order processing is correct so that emails sent by Westwing can be received at that address. In particular, if you use SPAM filters, you must ensure that all emails sent by Westwing or by third parties on behalf of Westwing to process your order can be delivered.
4. PRICES AND SHIPPING COSTS
4.1 Orders for goods on the www.westwing.fr website are subject to the prices indicated on the detail page of the item concerned at the time of the order (except in the case of possible obvious errors in the price). Prices are total prices including VAT and packaging. Shipping costs and, if applicable, fees for additional assembly service (see article 5) are added separately.
4.2 Shipping costs are charged separately for each order and are based on the price shown on the detail page of the respective good. They depend on the size, weight and shipping method, among other things. The latter is left to Westwing's discretion.
5. ASSEMBLY SERVICE
5.1 For some goods, assembly or installation at the desired location is offered as a separate additional service for a fee. It is available in almost all regions of France, with the exception of Martinique, Reunion and French Polynesia (hereinafter " assembly service "). If you need the assembly of the goods, you can order the assembly service by ticking the "Assembly service" field on the information page of the property, place the goods in the virtual shopping cart and complete the order by clicking on the "pay now" or "confirm payment" button. .Westwing does not guarantee that the goods can actually be assembled or fixed in the spaces that have been unilaterally provided for this purpose by the client. Westwing reserves the right not to offer the assembly service in individual cases, at its discretion. The installation carried out by the customer himself must be carried out in accordance with the corresponding assembly instructions.
5.2 Westwing may, at its option, perform the assembly service itself or have it performed by third parties (subcontractors) acting on behalf of Westwing. You do not have the right to choose a particular person to carry out the assembly service specifically ordered on the site.
5.3 If you have not already agreed on a delivery date via the appointment website, you will be contacted by Westwing or a Westwing subcontractor for an appointment after you have placed your order. For the provision of the assembly service, a suitable and easily accessible environment must be made available to the fitter, supported by reasonable cooperation on your part, if necessary (e.g. to allow access to the mounting location and to provide sufficient space for assembly).
5.4 Painting and upholstery work and/or electrical installations as well as wall and ceiling installations are excluded from the assembly service.
5.5 If you order the fitting service, you will have to pay an additional fee to the purchase price. The exact cost of this service will be communicated to you in advance of the time you place your order.
5.6 In the event of an order for an assembly service, the risk of accidental loss and damage to the goods will only pass to you after the completion of the assembly service and the delivery of the goods.
5.7 Westwing and its subcontractors are entitled to carry out a completion check after assembly and to retain visual documents of the successful completion of the assembly for internal documentation purposes.
6. PAYMENT TERMS
6.1 You may pay for the goods - subject to a credit check under conditions in accordance with the applicable legislation - by one of the following means of payment:
PayPal, credit/debit card (VISA, Mastercard, American Express), ApplePay, GooglePay (only when ordering via an internet browser) and Klarna.
6.2 Westwing currently accepts a variety of credit cards: VISA, Mastercard and American Express. Westwing will charge your credit card invoice amount upon receipt of the order through our payment service provider Stripe Payments Europe Ltd (registered in the Irish Commercial Register under number 3206488LH).
6.3 The payment methods ApplePay and GooglePay are processed by the payment service provider Stripe Payments Europe Ltd (registered in the Irish Commercial Register under number 32064LH).
6.4 If a payment method offered by PayPal is selected, the payment will be processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (registered in the commercial register under number R.C.S. Luxembourg B 118 349), subject to PayPal's terms of use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full.
6.5 Westwing offers you, together with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden (registered in the Swedish Commercial Register under number 556737-0431), the following payment options if you have a corresponding credit card: purchase on account with payment within 30 days, payment in three interest-free instalments. In this case, Westwing assigns its claim to Klarna.
7. BILLING
By accepting the T&Cs, you agree that Westwing may send you an invoice electronically or make an invoice available to you electronically, in accordance with Article 232 of Directive 2006/112/EC.
8. GOOD
8.1 Westwing offers different types of vouchers: gift certificates, promotional vouchers and compensation vouchers.
8.1.1 Gift vouchers
8.1.1.1 Gift vouchers are vouchers that can be purchased on the www.westwing.fr website and can only be used on the www.westwing.fr website, unless otherwise stated on the gift voucher. Gift vouchers will be emailed to you after the order has been placed.
8.1.1.2 Gift certificates and residual amounts of gift certificates can be used until the end of the third year following the year of purchase of the gift certificate.
8.1.1.3 For technical reasons, Westwing can only accept a maximum of five gift certificates per order. If you wish to purchase more than five gift certificates, please contact Westwing Customer Service (service@westwing.fr) to convert the gift certificates to one gift card. The full amount of the gift vouchers can then also be used in a single order.
8.1.1.4 Gift Certificates may only be used for the purchase of goods and services and not for the purchase of other Gift Certificates.
8.1.1.5 If the price of your order is higher than the credit of a gift voucher, you can pay the difference using the payment methods offered. If the price of your order is less than the credit of a gift certificate, you can use the remaining credit on your next order.
8.1.1.6 In the event of termination of an order contract - for whatever reason - the purchase price will be refunded by means of a gift voucher rebate or a refund to any other means of payment used.
8.1.1.7 The gift certificate is transferable.
8.1.1.8 Lost gift certificates, especially stolen ones, are non-refundable. Westwing is not responsible for any loss of gift certificates (and associated codes).
8.1.2 Promotional vouchers (including referral vouchers)
8.1.2.1 Promotional vouchers are vouchers issued free of charge as part of advertising campaigns with a fixed period of validity and which cannot be purchased by you. Promotional vouchers can only be used on the www.westwing.fr website during the specified period, but not on shipping or assembly charges. Promotional vouchers may be subject to other individual conditions. These will be communicated to you in direct connection with the voucher.
8.1.2.2 Promotional vouchers received as a new customer following an invitation from a Westwing member ("voucher for a friend") cannot be used if you already have an account with Westwing, as the voucher can only be used for new customers.
8.1.2.3 The first registration or new customer vouchers, which you receive once for registration on the www.westwing.fr website, can only be used once per customer account.
8.1.2.4 Only one promotional voucher can be used per order. It is not possible to refund or credit the balance of a promotional voucher if the value of the purchase is less than the value of the voucher.
8.1.2.5 The promotional voucher is non-transferable and non-refundable and cannot be used again if you return the goods or services paid for in whole or in part with the voucher under the statutory right of withdrawal. In the event of a proportional return of the ordered goods, the value of the voucher is distributed in proportion to the ordered goods, i.e. in the event of a return of individual items, the voucher is credited in proportion to the price of the returned goods and expires in proportion to the value of the goods. If a voucher is linked to a minimum order value, this must be reached even if the goods are partially returned, otherwise the credit of the voucher value does not apply.
8.1.4 Compensation Vouchers
8.1.4.1 Compensation Certificates are Certificates that cannot be purchased but are issued by Westwing at its discretion as compensation, without acknowledgment of any legal obligation.
8.1.4.2 The rules relating to promotional vouchers apply.
8.2 Westwing reserves the right, in the event of a justified suspicion of fraud or other activities contrary to the law or the conditions in connection with the purchase or redemption of a voucher, to block the relevant voucher code (also temporarily) or refuse the refund (also temporarily). In the latter case, you have the right to cancel the order.
8.3 A payment of the amount of the voucher is not possible, nor is it possible to transfer value or make subsequent payment for purchases that have already been made, i.e. before the end of the order process.
8.4 The above-mentioned vouchers can only be used by consumers.
9. DELIVERY AND SHIPPING CONDITIONS
9.1 Deliveries will only be made within France (with the exception of Martinique, Reunion and French Polynesia) to the delivery address you have indicated.
9.2 The basic delivery times will be communicated to you on the relevant property page.
9.3 The goods ordered are sent by parcel or carrier, at Westwing's discretion.
9.4 Westwing does not assume any procurement result, in that it is only required to deliver from its existing inventory of goods or from the delivery of ordered goods to suppliers. Westwing's delivery obligation does not apply if, despite an existing hedging transaction with the relevant supplier, Westwing does not receive, receive in full or does not receive the expected deliveries from its suppliers on time. In this case, Westwing will inform you without delay. Any sums paid, which by mutual agreement constitute deposits, will be reimbursed by Westwing, bearing in mind that you have in all cases the rights set out in articles L.216-1 et seq. of the Consumer Code (suspension of payment, termination of the contract after unexecuted formal notice to deliver within thirty days).
9.5 Westwing shall not be liable for the non-performance or insufficient performance of the obligations assumed by Westwing under this Agreement if and to the extent that this is due to the occurrence of a Force Majeure Event, without prejudice to the fact that Westwing shall endeavour to limit the consequences of such an event as far as possible.
Force majeure is defined as one or more unforeseen events which, even if foreseeable, are beyond Westwing's control and the effect on the performance of the contract could not have been prevented by Westwing's reasonable efforts. This includes, but is not limited to, war, conditions of war, insurrection, rebellion, military or civil coup, uproar, riot, embargo, governmental order, fire, flood, storm, hurricane or other severe weather conditions on the scale of a disaster, earthquake, lightning, pandemic, epidemic, nuclear hazard or any other similar cause beyond the control of Westwing and making it illegal, impossible or commercially impracticable to perform or comply with the obligations under these GTC. If a Force Majeure Event occurs, Westwing is obliged to notify you as soon as possible. Westwing is released from its obligation to perform for the duration of the event. Delivery and fulfillment times are extended accordingly. If the force majeure event lasts more than 8 weeks, you and Westwing have the right to terminate the contract.
9.6 If delivery of the goods fails for reasons within your control, Westwing will charge you for the cost of a new delivery together with reasonable storage costs from the day of the failed delivery. You will also be charged the cost of a new delivery if the first delivery was free for you. We will inform you of the additional costs before the new delivery and will only make the delivery with your consent. Please note that a refusal to accept does not constitute an effective exercise of your right of withdrawal, which must be expressly declared to Westwing. Westwing reserves the right to terminate the contract if you do not accept a new delivery within 7 days. In this case, Westwing will refund any payments already made. The same applies if you actually exercise your right of withdrawal. In this case, you will also be reimbursed for the shipping costs (standard shipping).
10. WARRANTIES, LIABILITIES AND DAMAGE DUE TO TRANSPORTATION
10.1. Legal guarantee of conformity
Westwing is obliged to assume any liability to you for any lack of conformity of the goods with the content of the order. Westwing is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation where this has been entrusted to it by the contract or has been carried out under its responsibility, or where the incorrect installation is due to gaps or errors in the installation instructions provided by Westwing.
Lack of conformity that appears within twenty-four months of the delivery of the goods is presumed to exist at the time of delivery (twelve months for second-hand goods), unless proven otherwise by Westwing.
In the event of a lack of conformity, you are entitled to have the goods brought into conformity by repair or replacement or, failing that, to a reduction in the price or to the termination of the contract. You also have the right to withhold payment of all or part of the prize or the delivery of the benefit under the contract until Westwing has fulfilled its obligations. The main articles of the Consumer Code describing the legal eviction guarantee regime are reproduced in Appendix 1 (Articles L. 217-1 et seq.).
10.2. Legal warranty against latent defectsWestwing is required to assume against you for latent defects affecting property, under the conditions set out in articles 1641 to 1648 of the Civil Code. The action resulting from a latent defect must be brought within two years of the discovery of the defect, pursuant to Article 1648 of the Civil Code. The articles of the Civil Code describing the legal warranty regime for latent defects are reproduced in Appendix 1 (Articles 1641 et seq.).
10.3 Without prejudice to the content of Articles 10.1 and 10.2, Westwing shall only be liable for direct, certain, foreseeable and proven damages, to the exclusion of all indirect damages.
10.4 If the goods are delivered with obviously damaged packaging or contents, please report this immediately to the relevant delivery company and contact Westwing (service@westwing.fr) customer service. This report does not affect your warranty rights, but makes it easier for Westwing to enforce its claims against the delivery company.
11. COMMERCIAL WARRANTY
An additional commercial guarantee only exists if it is explicitly stated and described on the detail page of the property.
12. RIGHT OF WITHDRAWAL FOR CONSUMERS
You have the right to exercise a right of withdrawal from an order with Westwing within fourteen (14) days without giving reasons. This period starts from: (i) the delivery of the goods, or (ii) in the case of an order for several goods delivered separately or an order for goods consisting of lots or multiple parts whose delivery is spread over a defined period, from the delivery of the last goods in the order, or (iii) for contracts for the provision of services, from the conclusion of the contract.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement (e.g. by letter sent by post or e-mail). You can use the following model withdrawal form, which is not mandatory:

For the refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you. We may refuse a refund until we have received the goods or you have provided proof that you have returned the goods, whichever is earlier.

the supply of goods made to the consumer's specifications or clearly personalised;
the supply of goods likely to deteriorate or expire quickly;
the supply of goods which, after having been delivered and by their nature, are inseparably mixed with other items.
14. VOLUNTARY RIGHT OF RETURN FOR CONSUMERS
14.1 For any purchase of goods, Westwing grants you a voluntary right of return for a total of 30 days from receipt of the goods, regardless of the statutory right of withdrawal provided for in Article 12. This voluntary right of return allows you to terminate the contract of sale even after the expiry of the statutory withdrawal period of 14 days (see Article 12) by returning the goods to Westwing within 30 days of receipt.
The exercise of the right of voluntary return is however subject to the condition that the goods are returned complete, in perfect condition and without damage in the original sales packaging. Otherwise, Westwing reserves the right to refuse the return. Please note that the risk and cost of return transport is borne by you when you return the goods under the right of voluntary return. The right of voluntary return does not apply to the purchase of gift vouchers.
14.2 The refund will be charged to the payment method you used for the payment. If direct debit has been chosen as a means of payment, you must not object to the direct debit without a legitimate reason.
14.3 Your statutory right of withdrawal (cf. Article 12) is not affected by compliance with the requirements set out in this Article 14 and continues to apply independently of them. Until the expiry of the statutory right of withdrawal period, only the legal conditions mentioned therein apply. This right of voluntary return contractually granted to you by Westwing does not limit the rights granted to you by law, in particular the right of withdrawal.
15. REIMBURSEMENT OF DELIVERY AND SERVICE COSTS IN THE EVENT OF PARTIAL WITHDRAWAL OR PARTIAL VOLUNTARY RETURN
If you exercise your right of withdrawal or right of voluntary return for only part of the goods in an order, Westwing will refund the payments made for the goods to which your notification relates, including the costs of initial delivery and assembly (if not yet fitted). However, if the delivery and assembly costs (or part of them) would also have been incurred in full if you had only ordered the goods for which you did not exercise a right of withdrawal or a voluntary right of return, these will be excluded from the refund.
16. RETENTION OF TITLE
The property remains the property of Westwing until paid in full.
